4 Types of Uber Lawsuits That Are Being Filed

Since 2009, Uber has enjoyed meteoric growth. Today, it operates in 70 countries, and Uber drivers complete more than 30 million trips every day. However, this growth has not been without problems, including serious legal challenges.

Here are four common types of lawsuits that are filed against Uber. 

1. Car Accident Claims

One of the most common claims against Uber involves auto accidents. These range from minor fender-benders to serious collisions causing injuries or fatalities. Lawsuits against Uber after a crash may involve: 

  • Uber passengers injured in an accident
  • Pedestrians struck by an Uber driver
  • Motorists injured in a crash caused by an Uber driver

Most of these lawsuits seek damages under Uber’s insurance policy for the negligent actions of the Uber driver. Sometimes, injured parties sue Uber for the company’s negligent practices. For example, a case may involve negligent hiring or retention practices if Uber hired or retained a driver with a history of DUIs, reckless driving, or a criminal record.

2. Wrongful Death

Between 2019 and 2020, fatal Uber accidents resulted in 101 deaths. When someone is killed in an accident involving an Uber driver, surviving family members may file a wrongful death claim against the at-fault driver. 

Uber’s insurance policy applies when the Uber driver causes an accident or the victim is an Uber rider. Wrongful death claims usually seek damages for funeral expenses, loss of companionship, lost income, and more.

3. Sexual Assault

The most alarming claims involve sexual assault and harassment by Uber drivers. 

On July 1, 2025, a Florida woman identified as I.J.R. filed a sexual assault lawsuit against Uber. She alleges that she was raped by an Uber driver using his wife’s Uber account. The suit claims Uber failed to use its “Real‑Time ID Check” feature, intended to confirm driver identity via selfie uploads. 

This case is part of a much larger legal wave. Over 2,300 civil suits alleging sexual assault and harassment have been consolidated into a federal MDL.

These lawsuits argue that Uber prioritized rapid growth and profit over passenger safety. Failing to implement identity checks, proper background vetting, and other safety measures put riders at risk. 

4. Discrimination

Uber has faced other discrimination lawsuits for issues such as: 

  • Drivers allegedly canceling or refusing rides based on race or disability
  • Discriminatory treatment of transgender and nonbinary drivers during onboarding or while active
  • Riders with service animals being refused service

Many lawsuits against Uber highlight systemic issues involving identity verification, driver screening, app oversight, and policy fairness. Oversights, gaps in regulation, and inconsistent policies cause real harm. Fortunately, courts are increasingly recognizing that tech platforms like Uber carry responsibility, especially when their systems make passengers vulnerable.
